Acceptible Use Policy (AUP)

INTRODUCTION

Alliance Internet Communications, LLC dba Kendallville Internet ("Alliance Internet") provides to customers a variety of services relating to the Internet and information technologies ("Service" or "Services"). The Service allows subscribers ("Customer" or "Customers") to connect to the Alliance Internet network and the Internet.

As the Customer, you are responsible to ensure all users of Service abide by the AUP. The Customer responsibility includes any Service usage by Customer, visitor to Customer, family, friend, neighbor, guest, employee, customer of Customer, or any other person using Service or any device connected to Service of Customer, whether known or unknown. Therefore, be sure to take appropriate action to secure your Service and control who and what device(s) connect to Service. Remember that the Internet is international in nature. Content not legal in the United States or appropriate may be obtainable from the Internet.

ILLEGAL ACTIVITY

The Services may not be used in connection with criminal or civil violations of local, state, or federal laws, regulations, or other government requirements. Such violations include theft or infringement of copyrights, trademarks, trade secrets, or other types of intellectual property; fraud; forgery; theft or misappropriation of funds, credit cards, or personal information; and threats of physical harm or harassment.

It is your responsibility to comply with all laws with respect to your use of the Service, including but not limited to, copyright laws, obscenity laws, defamation laws, etc. You are reminded that conduct that is illegal in other media (for example, violations of copyright laws) is also illegal on the Internet, and you are fully and solely responsible for the consequences of engaging in any illegal conduct by use of the Service.

As the Customer, you are responsible to ensure these activities are not performed using the Service.

DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

Under the Digital Millennium Copyright Act (DMCA), copyright owners have the right to notify Alliance Internet of any suspected infringement of their copyrights. When receiving a DMCA infringement notice, Alliance Internet forwards the DMCA notice of alleged infringement to the Customer referenced by the notice.

As required by law, Alliance Internet enforces compliance to the copyright laws by notifications, and may take action(s) specified in the services and terms contractual agreement with Customer ("Agreement").

PROHIBITED USE

You agree that you will not use or attempt to use the Service in any way or for any purposes described below:

  • To seek to gain unauthorized access to any other person’s computer, device, software, or data;

  • To send mass unsolicited e-mail to third parties;

  • To distribute or post any virus, worm, Trojan horse, or computer code intended to disrupt services, damage or destroy equipment or data, use equipment without authorization, or disrupt the operations of Alliance Internet or any other persons;

  • To waste resources (people, capacity, computer) through such actions;

  • To disrupt the intended use of the Internet by any means;

  • To destroy the integrity of computer-based information;

  • To compromise the privacy of users;

  • To seek to commit or participate in an illegal act through the use of the Service;

  • To send, submit for public posting, or intentionally receive, any abusive, obscene, profane, sexually explicit, threatening, or illegal material, or material containing blatant expressions of bigotry, racism or hate;

  • In any other manner, seek to interrupt or interfere with the Internet usage of any other persons;

  • To sell, assign, transfer or give away use of your Service without written authorization and consent from Alliance Internet;

  • To operate any service or system using the Service either accessible from the Internet or automatically processing or sending data over the Internet, except where explicitely permitted for a business customer for known business functions.

As the Customer, you are responsible to ensure these activities are not performed using the Service.

If it comes to the attention of Alliance Internet that you are using the Service in a manner of this type, Alliance Internet may, at their sole discretion, take any of the following actions in accordance with the severity and duration of the violations: warning the Customer; suspending the offending Customer from the Service; terminating the offending Customer from the service; imposing fees or charges on the offending Customer’s account in accordance with this AUP, the applicable service contract, or applicable law. You are responsible for material sent through or displayed on the Internet while using your Service, even if a claim should arise after termination of your Service.

SOFTWARE PROTECTION

To use Services, Customer is required to have and maintain protection from viruses and malicious software. Customer is responsible for activating and choosing the aggressiveness levels of anti-virus, anti-malware, and/or anti-SPAM software or services.

EQUIPMENT

Alliance Internet retains ownership of the equipment required to provide Service that has not been explicitely purchased by Customer ("Equipment").

Customer is responsible to protect, care for, and physically maintain the Equipment installed on the Customer premise. Customer cannot paint, cover, change, remove, replace, or otherwise modify the Equipment. Customer cannot move or remove Equipment attached to any fixture or structure.

Customer is liable to repair or replace Equipment damaged or lost. Customer is required to insure the Equipment against physical or electrical damage and theft. Alliance Internet will charge Customer for all loss and for service calls in accordance with the Customer Agreement.

ROUTER RENTAL

Alliance Internet may provide a router for use by Customer for Service ("Router"). The Router is not sold to Customer and Customer is charged a monthly fee for the use, support, and maintenance of the Router.

Customer may change the configuration of the Router according to the acceptable and authorized procedure specified by Alliance Internet. Customer may not alter or change Router or modify the software on the Router.

Customer may not remove the Router from use in providing Service without authorization of Alliance Internet.

SATELLITE INTERNET ACCESS

Alliance Internet offers satellite Internet access, which has a separate AUP for the satellite Internet Service.

SUPPORT

As part of using Services, Customer is responsible to report any problems they experience with Service to Alliance Internet. Customer should call Alliance Internet support for information pertaining to Service outages or Service degradation. Alliance Internet cannot resolve unknown problems.

Alliance Internet provides technical support for the Internet connection only, and does not provide any computer or networking support. Customer is responsible for any and all equipment, devices and software (other than a rented Router provided by Alliance Internet) you choose to install or use to receive use of the Service.

Alliance Internet will notify customers of disruptions of Service when feasible by a voice message available when calling the Alliance Internet phone number, and may also e-mail Customers.

Alliance Internet expressly disclaims any obligation to monitor its Customer and other users with respect to violations of the AUP. Alliance Internet has no liability or responsibility for the actions of any of its Customers or other users, or any content any Customer or user may make available while using the Service.

Alliance Internet is not responsible for or the consequences of any data or information lost due to use of Service.
